Nothing in these Online shopping terms and conditions affects your statutory rights, either as a consumer or otherwise.
Orders and Delivery Outside Dubai
Unless otherwise specified the materials on this Website are directed solely at customers who access this website from the emirate of Dubai. We do not represent that any item referred to in the materials on the Website is appropriate for use or available in locations outside the emirate of Dubai. If you choose to access the Website from locations outside the emirate of Dubai you are responsible for compliance with local laws if and to the extent local laws apply.
Delivery
Cut off time for orders are at 2 pm Dubai time, for delivery the next day. Deliveries are made between Saturday and Thursday. We make every effort to despatch items on time. If we are unable to deliver the items within your chosen arrival block, you are entitled to cancel the order and we will refund in full any charges which have been debited in respect of that order. If you want to cancel the order, we require the cancellation to be made within 24 hours of the time you placed the order. If the items are not delivered within the time period we specify in the confirmation email, please contact our customer service department quoting the order reference contained in your order confirmation email.
Delivery occurs when the items are delivered to the delivery address you specified when placing your order. At this point, responsibility for loss, breakage and damage passes to you. Ownership of items purchased does not pass to you until payment is received by us in full. You will asked to sign for acceptance of the goods which constitutes have the goods in correct and has been recieived in good condition. If you are not at the delivery address, we will assume that any adults that are present home are authorised by you to take delivery of the goods that you have ordered. However we will not leave the goods with anyone under the age of 21. If there is no one at the delivery address, or only people under the age of 21, we will not leave the goods at the delivery address. We will contact you to arrange an alternative delivery time. Please note that our delivery people will only deliver the goods to your front door. We do not deliver to hotels if the receivers name can not be confirmed by the Hotel. No deliveries will be done to meeting points. Same Day delivery Delivery will be made to MOST business addresses by 5pm and MOST residential addresses by 6pm. GENERALLY your order must be placed by 10am on the desired day of delivery in order for it to be delivered the same day. Conditions may apply for this as it depends on the distance of your desired delivery location and the availability of the goods you choose. We will contact you if it cannot be done on the same day. Free delivery Where free delivery is offered, it means within the emirate of Dubai only. Delivery may not take place on the same day. Children
We only sell items to adults (i.e. those aged 21 or over). If you are under 21, you may use this website only with the involvement of a parent or guardian. Colours, Specifications and Dimensions of Products
We have made every effort to display the colours, specifications and dimensions of items on the Website as accurately as possible. Flowers In arrangements of assorted flowers, the colors shown online will be used if at all possible, even if this means substituting other kinds of flowers of equal or greater value. If the floral container shown online is not available, a similar container will be used. Substitutions With floral gifts and gift baskets, substitutions may be necessary to ensure your arrangement or specialty gift is delivered in a timely manner. We accept orders for items subject to availability. If for any reason the items you ordered are no longer available, we will contact you using the contact details you supplied when placing your order and either: (a) offer you an alternative item of equivalent quality and price if this is possible; or (b) cancel the item from your order and give you a full refund in respect of that item. We regret that we cannot accept cheques, giftvouchers or cash as payment online. When you place your order, our system automatically asks your card issuer for authorisation for this amount. If we get a valid authorisation, your card issuer will hold this value expecting a charge from us. Receipt of your credit card details and debit of payments does not constitute our acceptance of your order. Please note that we cannot guarantee the security of data when you send us by email. Cancellations and Refunds
If you wish to cancel your order, please contact our Customer Services online. As we try to process orders immediately it may not always be possible to prevent an order from being dispatched. If your order has already been dispatched you may return the items under the following circumstances: 1. you must contact Customer Services within 24 hours of delivery of the goods; 2. the goods must not be perishable goods; and 3. we have the right to apply a AED10 admin fee. Please note that once we have dispatched items to you, you will not be able to cancel any contract you have with us for additional services carried out by us (e.g. gift wrapping). As soon as we receive notice of your cancellation of an item we will refund the relevant part of the purchase price for that item. If you are not satisfied with the quality of the goods you have purchased, you may call Customer Services and a representative will assess your request for a replacement product, credit or refund of the purchase price. Where we agree that the goods can be returned, credit for the value of the goods will be applied to your credit card or can, if you request, be applied to your next order where your next order is a greater value than the credit. This credit will be valid for use for one year from the date of issue. For perishable items such as flowers and food, we do ensure the fastest possible delivery to try to ensure maximum freshness but we cannot provide refunds unless you ring us within 2 hours of receipt of the goods. Incorrect Items
If we have sent you an incorrect item, please notify our Customer Services as soon as possible and they will arrange pickup. If you would like us to replace the incorrect item with the item you ordered we will send you the correct item as soon as possible..
Costs
We will reimburse any reasonable costs you incur in returning the following items to us:
items we delivered to you in error; items which were damaged upon delivery or are defective or incorrect; items which are substitutes for items originally ordered which we were unable to supply. Until you return such items to us you are responsible for their safe keeping and taking reasonable care of them.
Losses
We will be responsible for any losses you suffer as a direct result of us breaching these Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract for the sale of items by us to you was formed (i.e. at the point we send the confirmation email to you).
